Terms and conditions for Simply Fluent beta testers

Beta Test Agreement

This Beta Test Agreement (the “Agreement”) is between Simply Fluent OÃœ (“Simply Fluent”, “we”, or “us”) and you, the beta tester (“Tester” or “you”).

1. Purpose

This Agreement governs your participation in our beta testing program for the Simply Fluent application (the “Product”). As a beta tester, you’ll have early access to new features and functionality before they’re publicly available.

2. Confidentiality

During the beta test, you may have access to confidential information including the Product itself, unreleased features, development plans, and other proprietary information. You agree:

  • To keep all confidential information private and not share it with anyone not authorized by Simply Fluent
  • Not to post screenshots, videos, or descriptions of beta features on social media or public forums without our permission
  • Not to reverse engineer, decompile, or otherwise attempt to discover the source code of the Product

This confidentiality obligation continues even after the beta test concludes.

3. License to Use

We grant you a limited, non-exclusive, non-transferable license to use the Product solely for testing purposes during the beta period. This license will automatically terminate when:

  • The beta test period ends
  • We commercially release the tested features
  • We terminate your participation in the beta program
  • You violate any terms of this Agreement

4. Feedback and Reporting

As a beta tester, we ask that you:

  • Report any bugs, errors, or issues you encounter
  • Provide feedback on usability and features when requested
  • Complete any surveys or questionnaires we may provide
  • Promptly stop using any feature that causes significant issues and report the problem to us

Your feedback helps us improve Simply Fluent for everyone. Any feedback you provide becomes the property of Simply Fluent and may be used in future product development without compensation.

5. Data Processing

By participating in the beta program, you acknowledge and agree that:

  • We will collect usage data to monitor app performance and feature usage
  • Your personal information will be processed in accordance with our Privacy Policy
  • Your account data and feedback will be retained for the duration of the beta program and for a reasonable period afterward (not exceeding 12 months) to support product development

You have the right to request deletion of your personal data at any time, subject to our legitimate needs for beta program administration.

6. No Warranty

THE PRODUCT IS PROVIDED “AS IS” WITHOUT ANY WARRANTY OF ANY KIND. Beta software often contains bugs and errors. We do not guarantee that the Product will function without interruption or errors, and we are not liable for any damage arising from your use of the beta Product.

7. Term and Termination

Either party may terminate this Agreement at any time. Upon termination:

  • Your access to the beta features may be revoked
  • You must delete any unreleased beta software if requested
  • You must continue to maintain the confidentiality of any information you received

8. Limitation of Liability

To the maximum extent permitted by law, Simply Fluent shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages resulting from your participation in the beta program or use of the beta Product.

9. GDPR Compliance

As a beta tester, you have specific rights under the General Data Protection Regulation (GDPR) and other applicable data protection laws:

  • Right to Access: You may request copies of your personal data we hold
  • Right to Rectification: You may request that we correct inaccurate information
  • Right to Erasure: You may request deletion of your personal data, subject to certain exceptions
  • Right to Restrict Processing: You may request we restrict processing of your data
  • Right to Data Portability: You may request a copy of your data in a machine-readable format
  • Right to Object: You may object to our processing of your personal data

10. Third-Party Services

The beta Product may incorporate various third-party services for functionality, analytics, and feedback collection, including but not limited to:

  • Firebase Authentication for account management
  • Sentry for crash reporting and error tracking
  • Gleap for collecting feedback and reporting issues
  • RevenueCat for managing test subscriptions

Your use of these services through our beta Product is subject to their respective terms and privacy policies.

11. General Provisions

  • This Agreement is governed by the laws of Estonia
  • Any disputes shall be resolved through good faith negotiation or, if necessary, through arbitration in Tallinn, Estonia
  • This Agreement constitutes the entire agreement between you and Simply Fluent regarding the beta testing program

By checking the box on our beta application form or by using any beta feature, you acknowledge that you have read, understood, and agree to be bound by this Agreement.
